DEFINITIONS

 

Promoter – the promoter is J4 Campers Ltd, Company number 10941803

Competition – the Competition operated by the Promoter.  These Terms and Conditions apply to all competitions listed on the Promoter’s Website www.j4campers.co.uk

Prize – there will be a specific Prize for each competition. There may be more than one competition operating at any time.

Entrant – any person entering the Competition. All entrants must be aged 18 years or over and be a resident of the United Kingdom.

Closing Date – the date and time at which the Competition closes which will be displayed on the Website for each Competition.

Draw Date – the date and time at which the draw for the Winner will be made. This will be displayed on the Website for each Competition.

Winner – the Winner of the Prize will be the Entrant who has correctly answered the question or solved the problem whose ticket number has been drawn at random on the Draw Date.

We / Us / Our – the Promoter.

You – the Entrant.

  1. The Competition

1.1 Each Competition is skill based and requires the Entrant to answer a question or solve a problem set by the Promoter correctly to be entered into the draw.

1.2 If the Entrant does not answer the question correctly or does not solve the problem correctly they will not be entered into the draw.

1.3 Each Competition will run from and including the Opening date to and including the Closing date stated on the Website. All noted times and dates will be at Greenwich Mean Time.

1.4 The minimum and maximum number of ticket entries will be noted on the Website for each Competition.

1.5 Each Competition closes on the date specified as the Closing date or once the maximum number of entries for that specific Competition has been reached.

1.6 All Competition Entries must be received by the Promoter by no later than the specified time on the Closing date.

1.7 Postal entries must be received no later than three days after the Closing date.

1.8 The draw will take place on the Draw date specified on the Website for each Competition.

1.9 The Winner will be chosen at random on the Draw date and will receive the Prize in accordance with these Terms and Conditions. Proof of identity must be provided upon collection of any prize and must match the details provided when entering the respective Competition.

1.10 The Competition is not operated, endorsed or sponsored by any other party but third party Companies may be used for marketing and advertising.

  1. General

2.1 By entering the Competition via the Website, Entrants are deemed to have read and accepted these Terms and Conditions and agree to be bound by them.

2.2 Upon entering the Competition, all Entrants must submit all contact details as requested by the Promoter (which must include and not be limited to full name, valid email address, address and phone number) which will be used for the following purposes:
(a) to notify the Winner that they have won the prize

(b) to post the Winner’s name and town of residence on the Website

(c) to consent to future marketing content via email

(d) to comply with the Privacy Policy

2.3 All Entrants are solely and completely responsible for providing and maintaining the Promoter with accurate contact details.

2.4 The Promoter will be in no way liable for any failure or inability to make contact with any Entrant due to any errors or inaccuracies in the contact details provided by the Entrants.

  1. Competition & Eligibility

3.1 The Competition is operated and run by the Promoter and is open to UK residents only.

3.2 The Competition is open for entry to all persons aged 18 or over who reside in the UK excluding the Promoters, their direct family, professional advisers or anyone else connected with the development or operation of the Website or conducts administration of the Competition in any way, shape or form.

3.3 The Entrants and the Promoter recognise that the Competition, its administration and all associated activities are governed by English Law and the Promoter and Entrants recognise that the County or High Courts of England shall have exclusive jurisdiction in the event of any dispute arising out of the Competition or its administration. 

3.4 By entering the Competition, you confirm that you are eligible to do so and eligible to claim any prize you may win. The Promoter may require you to provide proof that you are eligible to enter the competition. If you fail to provide the Promoter with any such proof or other information that they may require within a reasonable time, you may be disqualified from the competition.

3.5 All Entrants acknowledge that by entering into the Competition that their payment for each individual entry to enter the Competition does not guarantee in any way that they will win the Prize.

3.6 As a condition of entering the Competition Entrants must ensure that by doing so, they do not contravene any laws of their country of residence. The Promoter will not be liable in any way if an Entrant enters the Competition unlawfully.

3.7 Once the Entrant has entered the Competition, the Entrant accepts sole responsibility for submitting information that is accurate, complete and true.

3.8 The Promoter reserves the right to refuse or disqualify any Entrant if there are reasonable grounds for believing that an Entrant has failed to comply with any of these Terms and Conditions or acted in a way that is reasonably considered by the Promoter to be illegal.

3.9 The Promoter will not accept competition entries that are:

  1. automatically generated by computer
  2. incomplete

3.10 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the Competition.

3.11 No refunds of the entry fee will be given in any event, including:

  1. If, following your entry into the Competition you subsequently fins out that you are not eligible to enter the Competition  or claim the Prize
  2. if, following your entry into the Competition the eligibility criteria for entering the Competition or claiming the Prize changes and you are no longer eligible
  3. if you are disqualified from the competition by the Promoter for any reason

3.12 All Entries will become the property of the Promoter on receipt and will not be returned.

3.13 Should any competition conclude early, a cash prize will be offered that is equivalent to 85% of the entry fees taken for that particular Competition.

  1. Entry Into the Competition

4.1 Online

a)          Go to the Website and view the Competition question.

b)          Select your answer to the question

c)          Complete the number of tickets you wish to purchase

d)         Add to the cart and proceed to checkout

e)         Complete the checkout process

4.2 By Post

a)        Go to the Website and view the Competition question.

b)        Put the name of the Competition and your answer to the question on a Postcard.

c)        Add your Full Name, Postal Address, Email address and Contact Number

d)        Add First Class or Second Class stamp.

e)       Send to : J4 Campers Ltd, Unit 10A Firsland Park Estate, Henfield Road, Albourne, West Sussex, BN6 9JJ

f)        Only 1 entry per person via postcard will be accepted

g)       Postal entries must be received no later than three days after the Closing date.

h)       Any entries that fail to follow the criteria mentioned above will be void as per any Entry received.

4.3 In answering the Question, the Entrant recognises that they must exercise skill, knowledge and judgment to give the correct answer.

4.4 Maximum entries for each entrant will be stated on each Competition, and will vary on each individual Competition, if none stated no maximum purchase applies.

4.5 To conclude an entry into the Competition, an Entrant will be asked to provide their contact details (including full name, postal and e-mail addresses and a telephone number) and card payment details (for entry fee only). Once the Entry is submitted, the Entrant’s card payment will be electronically approved.

4.6 When the Maximum Number of Entries and/or the Closing Date is reached, the Competition will close.

4.7 If the question is answered incorrectly then payment will still be made for the chosen amount of tickets and your name will not be entered into the final draw. You will not be notified that you have answered the question incorrectly at any point during the competition.

4.8 The Promoter reserves the right to extend the closing date at their sole discretion up to a maximum of 8 weeks duration from the competition Start date.

4.9 All Entries to the Competition are final and no refunds shall be made at any time or for any reason, except in the case of entries submitted after the Closing Date or if the Promoter cancels the competition. This is at the Promotor’s sole discretion and may be amended on a case by case basis.

4.10 Each Entrant agrees that the usual requirement under the Consumer Protection (Distance Selling) Regulations 2000 for any goods and services ordered online to be supplied within 30 days will not apply to this Prize Competition.

4.11 The Promoter’s decision is final and no correspondence will be entered into about the result of the Competition following the determination of the Winner.

  1. The Prize

5.1 The Prize for the Competition is described on the Website. Details of the Prize are to the best of the Promoters knowledge, information and belief, correct as at the Opening Date.

5.2 The Promoter makes no representations and gives no warranties about the Prize, it’s value, it’s condition or any other information provided on the Website. The Promoter makes no representations and gives no warranties that the information provided on the Website is accurate, complete or up to date.

5.3 The Promoter owns any prize offered from the time the competition is live until successful handover is completed as outlined in section 5.7

5.4 The prize will only be that as awarded at the time of the draw. No alternatives will be offered under any circumstance.

5.5 The Prize is pre-owned unless stated otherwise on the Website.

5.6 If the Prize is a vehicle:

  1. it will come with a valid MOT (if required)
  2. it will be the Winner’s responsibility to ensure the vehicle is adequately insured prior to taking it out on public roads
  3. no road fund licence is included as part of the Prize
  4. the Promoter has no responsibility for the Prize once it has been collected. The Winner is solely responsible for complying with all relevant laws and regulations relating to the vehicle, it’s operation and ensuring they operate the vehicle in a safe and responsible manner

5.7 Delivery or collection of the prize will be organised between the Promoter and the Winner after completion of the Competition Draw.

  1. Closing the Competition

6.1 The competition will close on the proposed Closing Date unless the minimum number of tickets has not been reached.

6.2 The Draw date will take place on the date specified on the Website for each individual competition, unless the minimum number of tickets has not been reached.

6.3 If the Number of Entries to the Competition does not meet the minimum number of entries at the Closing Date, the Competition will either be extended for a total of up to 8 weeks or will close and the proceeds will either be deemed sufficient to award the prize at the sole discretion of the Promoter, or the remaining funds will be allocated as a cash prize equal to 85% of the entry fees to a Winner. The remaining 15% will be used to cover any expenses and marketing fees.

6.4 The Promoter will be entitled to retain a percentage of the Entry Fees to cover administration (which will be equal to 15% of the entry fees). The remaining balance following deduction of the Promoter’s expenses is “the Prize Fund”. The Prize Fund will then be offered to the Winner.

6.5 All Entrants who correctly answer the Competition question or solve the Competition problem will be entered into the draw.

6.6 A ticket number will be randomly drawn using a Random Number Generator

6.7 The winning Entrant will be the Entrant whose ticket number has been selected.

6.8 There will only be one Winner per Competition unless otherwise indicated.

6.9 The Promoter will contact the Winner as soon as practicable after the Draw Date using the contact details provided with the Competition entry.

6.10 If the winner cannot be contacted, is not available, or has not claimed the Prize, within 7 days of the Draw Date the Promoter reserves the right to offer the Prize to another Entrant (“The Alternate Winner“) selected at random in the same method as before from the remaining correct entries received before the Closing Date.

6.11 The Alternate Winner shall have 7 days from notification of their status by the Promoter to communicate their acceptance of the Prize. This process shall continue until a Winner accepts the Prize.

6.12 If the Competition is completed and the Prize is issued successfully then the Prize will be transferred by the Promoter to the Winner.

6.13 The Winner must claim the Prize personally.

6.14 If the Prize is a vehicle transfer of the V5C documentation will be carried out on collection of the Prize. The Winner will need to organise for insurance and taxation of the vehicle at their own expense.

 

  1. Miscellaneous

7.1 The Promoter reserves the right to amend these terms and conditions at any time. Any changes will be immediately published on the competition home page.

7.2 These Competition Terms and Conditions shall not create or be construed as creating any form of contract, joint venture or other agreement between any Entrant and the Promoter.

7.3 An entry shall be declared void (without any refund being given) if the Entrant engages in: (a) any form of fraud (actual or apparent); (b) fraudulent misrepresentation; (c) fraudulent concealment; (d) hacking or interference with the proper functioning of the website; or (e) amending, or unauthorised use of, any of the code that constitutes the Website.

7.4 The Promoter does not accept responsibility for entries which are not received due to failures in computer systems, other malfunctions, high Internet traffic, hardware failure, software failure, server faults or any other reason.

7.5 The Promoter does not accept responsibility for postal entries which are not received or not received by the Closing Date.

7.6 The Promoter will not be liable for any loss suffered by an Entrant as a result of incomplete entries or failed computer communications or for any loss suffered as a result of use of the Website.

7.7 Save for death or personal injury, the Promoter will not be liable for any loss (including economic loss) suffered to or sustained by any person or property as a result of any act or omission of the Promoters, nor will their servants or their agents in developing, planning and Administrating the Competition, distributing the Prize to the Winner or following the distribution of the Prize; The Promoter accepts no liability for errors or omissions contained within the Prize details, description or specification or any other part of the Website. It is the responsibility of each Entrant (and in particular the Winner) to satisfy him/herself as to the accuracy of any such details and/or any content of this website.

7.8 The Promoter reserves the right to cancel the Competition at any time either before or after tickets have been sold. If the Competition is cancelled, the Promoter will return any Entry Fees paid to each Entrant (either by bank card refund or by cheque and in one combined payment where several entries have been made by a competitor). Where the Entry Fee is returned, the Promoter shall have no further liability to the Entrant or to any other person.

7.9 The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the full name and county/town of residence of major prize winners on the Website.

7.10 The Winner agrees to allow the Promoter to display their name on the Website in accordance with the Privacy Policy.

7.11 The Winner also agrees upon acceptance of the Prize that they are required to have photo(s) and or video(s) taken for promotional purposes, both directly after their win and in any future promotional material.

7.12 Entrants authorise the Promoter to enter their personal details into their database and to use the information in accordance with the provisions of the Data Protection Act 1998 and subject to the terms of Privacy Policy.

 

  1. Privacy Policy

8.1 The Entrants and the Promoter recognise that the Promoter may use contact details and other data including personal data as defined by the Data Protection Act 1998 supplied by the Entrants to the Promoter to administer the Website and conduct the Competition according to these Terms and Conditions.

8.2 The Entrants and the Promoter also recognise that the Promoter may (either by choice or at the request of a third party) also disclose this information to relevant third parties for the purposes of the prevention of fraud, money laundering, legal or other financial or regulatory reasons.
